Human Rights and Asylum
Glazer Delmar are extremely well known for our often ground-breaking human rights and asylum work. We have been involved in leading cases, particularly those involving the right to family/private life (Article 8 ECHR). We are able to assist in first time claims for asylum and can advise you before you even approach the UK Border Agency. We are willing to accompany you to interviews and can “hold your hand” through the entire process.
If your claim for asylum has been refused and the appeal process exhausted, we can advise you on any other options open to you. In addition, if you claimed asylum before March 2007, you may have a legacy case and we would be able to advise you on this.
If you have serious health problems (physical or mental), we can assist you in submitting an application for leave to remain in the UK on this basis. Such applications are often known as “Article 3” applications, as the basis of your claim would be that to return you to your country of origin would be inhuman or degrading.
“The right to family/private life” is a right protected under Article 8 ECHR. Applications to the Home Office can be submitted on this basis alone and if, for example, you are an overstayer who has been in the UK for several years) and possibly has established a family in the UK) this type of application may be suitable for you.
